서비스 이용약관
Article 1 (Purpose)
These Terms of Service are established to define the rights, obligations, and responsibilities between the Company and members in using electronic commerce-related services (hereinafter "Service") provided through the ND CAREON+ internet website and mobile application (hereinafter "Site") operated by Namdo Market Co., Ltd. (hereinafter "Company").
Article 2 (Definitions of Terms)
① "Service" refers to an institutional-level welfare mall (B2B2C) e-commerce service in which the Company provides products registered in wholesale markets (Namdaemun, Dongdaemun, etc.) on an institution-by-institution basis and supports members belonging to institutions to purchase such products.
② "Institution Manager" means a person who has entered into a contract with the Company and has the authority to approve and manage the service use of members belonging to that institution.
③ "Member (Constituent)" means a person who has registered on the Site with the approval of an institution manager and is able to order products at the welfare mall.
④ "Wholesale Member (Seller)" means a business operator who registers and sells products on the Company's B2B platform (ND MARKET).
⑤ "Non-Member" means a person who uses the Service in a limited manner without registering as a member.
⑥ "User ID" means the email address set by the member for member identification and service use and approved by the Company.
⑦ "Password" means a combination of letters and numbers set by the member for member identity verification.
⑧ "Refund" means returning the payment amount when a transaction is cancelled or discontinued in accordance with the "Electronic Commerce Act" and "Consumer Protection Act."
⑨ Terms not defined in these Terms of Service shall be governed by applicable laws and general commercial practices.
Article 3 (Display of Terms, Explanation, and Amendment)
① The Company shall post these Terms of Service on the initial screen of the Service or linked screen so that members are aware of the content.
② The Company may amend these Terms of Service to the extent it does not violate applicable laws such as the "Act on the Regulation of Terms and Conditions," "Electronic Commerce Act," and others.
③ When the Company amends the Terms, it shall specify the reasons for amendment and the effective date and provide notice together with the current Terms at least 7 days before the effective date. However, in the case of amendments that are unfavorable to members, the Company shall provide notice at least 30 days in advance.
④ Members have the right to refuse to agree to amended Terms, and if they do not agree, they may terminate the service agreement.
Article 4 (Rules Other Than These Terms)
Matters not prescribed in these Terms and the interpretation of these Terms shall be governed by applicable laws such as the "Electronic Commerce Act," "Consumer Protection Act," "Act on the Regulation of Terms and Conditions," "Personal Information Protection Act," and general commercial practices.
Article 5 (Service Provision and Changes)
① The Company provides the following services.
- Wholesale product-based welfare mall operation service
- Product order and payment agency service
- Direct pickup at Namdo Market and combined packaging shipping service
- Institution-level member management service
- Customer center consulting and exchange/refund support service
- Customized product recommendations, promotions, and other additional services (with member consent)
② The ND CAREON+ Service is based in principle on a B2B contract concluded between the Company and the using institution (institution manager).
③ Product orders are notified to sellers (wholesale members) in the name of the using institution, and after the Company directly picks up and inspects the products at the wholesale market, they are sent to members of that institution through outsourced shipping.
④ The Company may modify or suspend part or all of the Service being provided when there are unavoidable reasons, and shall provide prior notice.
⑤ When modifying or suspending free services, the Company shall not provide separate compensation. However, in the case of paid services, the Company shall provide refunds or alternative services within a reasonable range.
Article 6 (Member Registration and Service Agreement Formation)
① Member registration is established after a member agrees to these Terms, submits their member information, and obtains approval from the institution manager and the Company.
② The Company may refuse member registration or terminate membership if any of the following applies:
- False information is provided or information is omitted
- Identity fraud of others
- Use of the Service in violation of laws or for unlawful or improper purposes
- Lack of approval from the institution manager
③ The approval and eligibility of members are entirely at the discretion of the institution manager.
④ The Company (Namdo Market) shall not be liable for any damages incurred by the institution or third parties due to approval errors by the institution manager or membership of ineligible members. The responsibility for approval rests with the institution manager.
⑤ The Company may restrict or terminate the authority of an institution manager in the following cases:
- When the approval authority is exercised based on false or inaccurate information
- When an ineligible member is approved due to intentional conduct or gross negligence, causing damage to the institution member or the Company
- When the Terms, applicable laws, or Company policies are violated
- When the Company reasonably deems it necessary for other reasons
Article 7 (Member Withdrawal and Loss of Qualification)
① Members may request withdrawal from the Company at any time, and the Company shall process such requests in accordance with the procedures prescribed by applicable laws.
② The Company may restrict, suspend, or terminate member status if a member falls under any of the following categories:
- False information is provided upon membership application
- The member's conduct infringes on the rights or reputation of others or interferes with the operation of the Service
- The member violates applicable laws or these Terms
③ When a member's status is terminated, the Company shall notify the member of such fact and, if necessary, provide an opportunity for the member to present their case.
Article 8 (Member Obligations)
① Members must comply with applicable laws, these Terms, and the Company's notices and shall not engage in any of the following activities:
- Provision of false information
- Identity theft of others
- Infringement of intellectual property rights of the Company or third parties
- Information collection using automated programs, crawling, or other similar means
- Posting of abusive language, violent language, obscene or illegal information
- Conduct that interferes with normal operation of the Service
② If a member violates this Article, the Company may take measures such as service restriction, contract termination, or claim for damages.
Article 9 (Purchase and Payment)
① Members may order products on the Site, and payment shall be made through payment methods designated by the Company (credit cards, simple payments, account transfers, etc.).
② Payment is processed securely through Korea Information and Communications Co., Ltd. (EasyPay), to which the Company has outsourced payment processing.
③ The product order and contracting party is deemed to be the using institution, and the seller (wholesale member) recognizes the institution as the trading counterparty.
④ The Company picks up and inspects products based on the order details of the using institution and sends them to members of that institution through outsourced shipping.
⑤ The product amount provided to members may differ from the actual wholesale price and may vary depending on the Company's service operation policy, fees, shipping costs, welfare mall operation costs, etc.
⑥ When transaction conditions (price, fees, shipping costs, etc.) are changed, the Company shall provide prior notice to members through the service screen or notices.
⑦ Orders are confirmed upon completion of payment.
Article 10 (Shipping)
① Shipping is carried out by the Company directly picking up and combining packages, which are then sent through courier service.
② Shipping is to be completed within 3 business days from the order date in principle; however, it may be delayed due to force majeure such as natural disasters, wholesale market conditions, or courier company circumstances.
③ Shipping fees are notified at the time of order and shall be borne by the member.
④ Even if a member receives free shipping benefits when purchasing products, if the reason for exchange or refund is attributable to the member, the member must bear the full round-trip shipping fees, including the costs incurred in the original shipment.
Article 11 (Exchange and Refund)
① Exchange and refund shall follow the "Electronic Commerce Act" and "Consumer Protection Act."
② The Company shall bear shipping fees in the following cases:
- When a product is shipped incorrectly in a manner different from the order details
- When a defect (defect, damage, etc.) in the product itself is confirmed
- When a product different from the order is shipped, such as color or size
③ Exchange and refund are available in the following cases; however, the member shall bear the round-trip shipping fees incurred in such cases**.**
- When due to the member's simple change of mind
- When due to other member circumstances
- Round-trip shipping fees include the free shipping benefit provided at the time of purchase, and the member must bear both the cost of returning the product to the Company or seller and the cost of receiving the product again after exchange and refund processing.
④ Exchange and refund may be restricted in the following cases:
- When more than 7 days have passed since receipt of the product (provided that this does not apply if the product has a defect)
- When the product value has decreased to such an extent that it cannot be resold due to damage caused by the member
- When the product value has significantly decreased over time
- In the case of products subject to withdrawal of offer restrictions, such as custom-made products
⑤ Requests for exchange or refund must be submitted through the Company's customer center within 7 days of receipt of the product.
⑥ However, if applicable laws provide otherwise, such laws shall apply.
Article 12 (Information Provision and Advertising)
① The Company may provide various information necessary for service use to members via email, text message, app push, or other means.
② The Company may post advertisements in connection with service operation, and advertising information is sent only with the prior consent of the member.
③ Members may refuse to receive advertising information at any time.
Article 13 (Intellectual Property Rights and Content Management)
① All intellectual property rights to content posted on the Site (images, text, designs, etc.) belong to the Company. However, copyrights to reviews and posts written by members belong to the respective members.
② Members grant the Company a non-exclusive, royalty-free right to use content they have created for service operation and promotional purposes.
③ If content written by a member falls under any of the following categories, the Company may delete the content or make it private without prior notice:
- The content infringes on or defames the rights or reputation of others
- The content violates public order and good morals, such as obscenity or illegal information
- The content is commercial advertising information unrelated to the Service
- The content violates applicable laws and Company policies
Article 14 (Personal Information Protection)
① The Company collects only the minimum personal information necessary to provide the Service and complies with the "Personal Information Protection Act."
② The Company retains personal information for transaction records such as contracts and payments for 5 years, consumer complaints and dispute resolution records for 3 years, and for other periods prescribed by applicable laws.
③ Matters regarding collection, use, provision, and outsourcing of personal information shall be governed by a separate Personal Information Protection Policy.
Article 15 (Company's Liability Exemption)
① The Company shall not be liable for cases where the Service cannot be provided due to force majeure such as natural disasters, system failures, communication interruptions, and others.
② The Company shall not be liable for service failures due to reasons attributable to members.
③ As a communication sales intermediary, the Company does not warrant the quality, legality, or inventory of registered products; however, the Company shall be liable if there is a reason attributable to the Company during the shipping process.
Article 16 (Dispute Resolution and Jurisdiction)
① The Company shall make efforts to promptly address complaints raised by members.
② In the event of a dispute between the Company and a member, the dispute may be resolved through mediation via a dispute resolution organization in accordance with applicable laws such as the "Electronic Commerce Act," or the member may file a civil lawsuit at the competent court under the Code of Civil Procedure.
③ The interpretation of and disputes regarding these Terms shall be governed by the laws of the Republic of Korea.
